Terms and Conditions
1. Scope
These terms and conditions apply to all business relationships between aifinity GmbH ("Provider") and its customers ("Customer") regarding the NiceCheckIn services.
2. Services
NiceCheckIn provides cloud-based check-in solutions for entertainment venues, including:
- Terminal hardware for ticket scanning and validation
- Cloud software for check-in management
- Integration services with existing systems
- Remote management and support
3. Contract Formation
A contract is formed when the Provider confirms the Customer's order in writing or through electronic communication, or when the Provider begins to perform the services.
4. Prices and Payment
All prices are net prices plus applicable value added tax. Payment terms are as specified in the individual contract or invoice.
5. Warranty
The Provider warrants that the services will be performed with reasonable skill and care. Hardware warranty periods are as specified in the product documentation.
6. Liability
The Provider's liability is limited to intent and gross negligence. Liability for indirect damages, lost profits, or consequential damages is excluded to the extent permitted by law.
7. Data Protection
The Provider processes personal data in accordance with applicable data protection laws. Details are set out in the Privacy Policy.
8. Confidentiality
Both parties agree to keep confidential all information obtained in connection with the business relationship that is designated as confidential or is obviously confidential.
9. Term and Termination
The contract term and notice periods are as specified in the individual contract. Either party may terminate the contract for cause without notice in case of material breach.
10. Applicable Law
These terms and conditions are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Rosenheim, Germany.
11. Severability
If any provision of these terms and conditions is found to be invalid, the remaining provisions shall remain in full force and effect.
